Terms and Conditions – StudioShare

Read these terms and conditions (“Terms”) carefully before using StudioShare, a platform for renting creative spaces (“Platform”). These terms govern your access to and use of the platform, including all bookings and transactions made through it. By accessing or using the platform, you agree to be bound by these terms. If you do not agree to any part of these terms, you may not use the platform.

1. Platform Use and Authorization:

1.1 The platform operates as a marketplace connecting individuals seeking to rent music studios, rehearsal spaces, and podcasting areas (“Tenants”) with individuals or entities offering music studios, rehearsal spaces, and podcasting areas for rent (“Studio/Rehearsal Space Owners”).

1.2 By using the Platform, you confirm that you are at least 18 years old and capable of entering into a legally binding agreement. If you use the platform on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization or entity to these terms.

2. Booking and Rental Terms:

2.1 StudioShare facilitates the booking and rental process between tenants and hosts. Tenants can browse available studios, check availability, and send booking requests through the platform.

2.2 Studio owners/hosts have the right to accept or decline booking requests. Once a booking request is accepted, a legally binding agreement is formed between the tenant and the studio owner.

2.3 Tenants agree to use the rented studio only for lawful and authorized purposes, respecting all rules and restrictions set by the host.

2.4 Tenants are responsible for leaving the studio in the same condition as they found it, taking care of the equipment, and promptly reporting any damages or issues to the host.

2.5 Studio owners/hosts are responsible for accurately representing their studios, providing necessary information, and ensuring the studio is available for confirmed bookings.

3. Payment and Fees:

3.1 Tenants will be charged the agreed-upon rental fees, which may include daily rates, additional services, and any applicable taxes or fees.

3.2 StudioShare may collect payments on behalf of hosts. Tenants authorize StudioShare to charge their payment method for the total amount due, which will be transferred to the owner/host after deduction of any applicable service fees.

3.3 Hosts are responsible for setting their rental fees, which should be reasonable and aligned with the market value of similar properties.

3.4 StudioShare charges service fees or commissions for the use of the platform, which will be clearly displayed for tenants during the booking process. Currently, 13% for tenants and 3% for hosts.

4. Cancellations and Refunds:

4.1 Cancellation policies may vary between hosts and will be clearly stated on each studio booking. Tenants are responsible for reviewing and understanding the cancellation policy before making a booking.

Refund Policy for StudioShare

Cancellation by Guest Bookings:

If a guest cancels a booking, the following refund policy applies:
Cancellation 72 hours before the booking start date: Full refund. StudioShare’s service fee is refundable.
Cancellation made less than 48 hours before the booking start date: No refund will be provided. StudioShare’s service fee is non-refundable.
Guests may be entitled to a 50% refund of accommodation fees or a credit if they cancel the booking at least 48-72 hours before the check-in time. StudioShare’s service fee is non-refundable.

Cancellation by Host Bookings:

In the rare event that a host cancels a booking, guests will receive a full refund, including any service fees, and will be assisted in finding an alternative location.

Processing Time for Refunds:

Refunds will be processed within 7 business days after the cancellation request.

Refund Method:

Refunds will be issued to the original payment method used for the booking.

Service Fees:

StudioShare’s service fees are non-refundable, except in cases where both the host and guest agree to a full refund, including service fees.

Disputes and Exceptions:

In exceptional circumstances or disputes between hosts and guests, StudioShare will review the situation and may make exceptions to this refund policy to ensure fairness and customer satisfaction.

Change of Booking Dates:

Guests may request a change of booking dates if available. Hosts have the discretion to approve or deny date change requests.

No-Shows:

If a guest fails to show up for a booking and does not officially cancel, no refund will be provided.

Canceled or Rescheduled Bookings Due to Force Majeure (Unforeseen Events):

In cases of unforeseen events or force majeure (e.g., natural disasters, government restrictions) resulting in canceled or rescheduled bookings, StudioShare will collaborate with hosts and guests to find equitable solutions, including rescheduling or refunds as needed.

Please note that this refund policy may change, and specific terms may vary depending on booking details and local regulations. Guests and hosts are encouraged to review the cancellation policy stated in the booking listing for any additional terms that may apply to their specific reservation.

4.2 Hosts have the right to specify their own cancellation policies, including any refund or penalty fees.

4.3 Tenants may be eligible for full or partial refunds according to the Studio Owner’s cancellation policies. Refunds, if applicable, will be processed according to the chosen payment method and timeframe stated in the cancellation policy.

5. Disputes and Liability:

5.1 StudioShare is not responsible for tenant or host behavior, the condition of the studios, or any disputes that may arise between users.

5.2 Any issues or disputes between tenants and studio owners should be resolved directly between the parties involved. StudioShare may, at its discretion, provide dispute resolution assistance but is not obligated to do so.

5.3 StudioShare does not assume any responsibility for the accuracy of studio listings, the quality of the studios, or any damages or losses incurred during the rental period.

6. User Conduct and Responsibility:

6.1 Users agree to use the platform in accordance with applicable laws and regulations and to respect the rights of other users.

6.2 Users may not engage in any fraudulent, abusive, or illegal activities when using the platform. This includes but is not limited to misrepresentation, unauthorized use of intellectual property, harassment, or any activity that may disrupt or impair the platform’s operation.

6.3 Users are responsible for maintaining the confidentiality of their account information, including login credentials, and for any activity that occurs under their account.

6.4 Users may not attempt to gain unauthorized access to the Platform or interfere with its systems or security features.

6.5 Users are encouraged to provide honest and accurate feedback and reviews regarding their rental experiences. However, all reviews or comments should be respectful and based on genuine experiences.

7. Intellectual Property Rights:

7.1 The platform and its content, including but not limited to logos, trademarks, text, graphics, images, and software, belong to StudioShare or its licensors and are protected by intellectual property

laws.

7.2 Users may not reproduce, distribute, modify, or create derivative works of the platform or its content without prior written consent from StudioShare.

7.3 By submitting any content or materials to the platform, users grant StudioShare a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, and distribute such content in any form or medium.

8. Privacy Policy:

8.1 StudioShare collects, stores, and processes personal information in accordance with its Privacy Policy, which can be found on the platform.

8.2 By using the platform, users consent to the collection, storage, and processing of their personal information as described in the Privacy Policy.

9. Termination:

9.1 StudioShare reserves the right to suspend or terminate user accounts and access to the platform at its discretion, without prior notice, if users violate these terms or engage in any prohibited conduct.

9.2 Users may terminate their accounts at any time by contacting StudioShare customer support.

9.3 Upon termination, all rights and licenses granted to users will cease, and they must cease all use of the platform and delete any downloaded or printed materials obtained from it.

10. Changes to Terms:

10.1 StudioShare may modify or update these terms from time to time, and any changes will be effective upon posting on the platform.

10.2 Users are responsible for regularly reviewing these terms to stay informed of any updates. Continued use of the platform after the posting of changes constitutes acceptance of the modified terms.

11. Governing Law and Jurisdiction:

11.1 These terms and any disputes arising out of or relating to them shall be governed by the laws of  Wyoming, without regard to its conflict of law provisions.

11.2 Any disputes arising under these terms shall be resolved exclusively by the competent courts of Wyoming.
